The US Court of International Trade upheld the Commerce Department’s fourth remand determination in the long-running Canadian softwood lumber dispute, leaving in place a 1.05% countervailing duty rate for Quebec producers Les Produits Forestiers D&G and its affiliate Portbec. The revised rate followed Commerce’s decision to reopen the record and account for certain duty-paid lumber purchases in the United States, reducing the companies’ subsidy rate from 1.75% to 1.05%. The court rejected challenges from the US Lumber Coalition and other plaintiffs, ruling that several objections related to alleged upstream subsidies had either been forfeited or were raised too late in the proceedings. It also dismissed claims that Commerce’s determination conflicted with the Supreme Court’s Loper Bright decision. Although the lower rate remains above the de minimis threshold, the ruling brings another chapter of the lengthy expedited review litigation to a close.
