A BC tribunal has upheld a $75,000 fine issued to Tolko Industries after a logging road it built in the Shuswap caused a landslide. According to a July 15 Forest Appeals Commission decision… the landslide happened because of inadequate risk assessment during road design, planning, construction, and post-construction inspection. Tolko was fined $75,000 but appealed, arguing the fine was excessive. …Tolko didn’t deny that it caused the landslide, but appealed the amount of the fine. The province argued the fine was appropriate, pointing out that over the years on two previous occasions Tolko had been fined for the same thing. …However, the Commission wasn’t sold. …The Commission said a fine had to act as a strong deterrence. …On top of the $75,000 fine, Tolko will also have to pay to cover the cost of any timber lost in the landslide, which has yet to be determined.
